The Internal Revenue Service released a report this week containing the names of 275,000 nonprofit organizations which have been stripped of tax exempt status. A federal law enacted in 2006 requires nearly all tax exempt organizations to file a report with the IRS annually to retain federal not-for-profit tax exemptions. Unfortunately, the law only allows the tax exempt status be revoked when the required annual report is not filed for a period of three consecutive years.
Groups out of compliance could still apply for grants which require tax exempt or nonprofit status to be eligible for receipt of taxpayer dollars. A nonprofit organization which neglected to file the required report for two years but completed the document during the third year could still retain tax exempt status.
If filing a financial and activities report with the IRS is supposed to provide a checks and balances aspect to be exempt from paying taxes and applying for grants, it is definitely missing the mark. Caring Americans donate money and approve operating levies to support nonprofit agencies expect their money to be going toward a worthy goal to help the community and not an organization which disobeys accountability and transparency rules.
While some of the nonprofit organizations on the IRS 2011 list were formed for a specific purpose designed to only last for a single year or ended due to a facility closing, the end enrollment forms still should have been processed properly. As long as the tax exempt status remains in effect any member of the formerly active group could purchase materials or services without paying proper taxes.
